Welcome to NomadMouse. These Terms and Conditions (“Terms”) govern your access to and use of the NomadMouse website and services located at https://www.nomadmouse.com/ (the “Site”), whether you access the Site as a visitor, commenter, or otherwise. By using the Site you agree to these Terms. If you do not agree, do not access or use the Site.

1. Who We Are / Operator

The Site is operated under the name NomadMouse. These Terms are written in neutral operator language to accommodate the current status of the project and possible future business registration. References to “NomadMouse,” “we,” “us,” and “our” mean the Site operator. References to “you” and “your” mean the person or entity accessing or using the Site.

2. Scope of Services

NomadMouse publishes recipes, food-related editorial content, images, and related resources. The Site is intended for informational and personal, non-commercial use only unless otherwise agreed in writing. We do not currently require users to register for accounts; you can browse most content without creating an account. We may introduce optional or required user accounts and additional features in the future; those features may be subject to separate terms and conditions and privacy disclosures.

Voluntary submissions: We collect names, email addresses, and the content of comments or messages only when you voluntarily submit them via Site forms, comment fields, or contact mechanisms.
IP addresses and logs: We collect IP addresses and related connection information for security, fraud prevention, abuse detection, diagnostic logging, and performance monitoring.

5. Ownership of Content

Site content: All content on the Site — including text, recipes, images, graphics, designs, logos, trademarks, code, and other materials — is the sole property of NomadMouse or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Limited license to users: Subject to these Terms, NomadMouse grants you a limited, non-exclusive, revocable, non-transferable license to access and view Site content for personal, non-commercial use only.
No transfer of ownership: Nothing in these Terms transfers ownership of Site content to you.

6. User-Generated Content

Definition: “User-Generated Content” means any content you post, upload, publish, submit, or otherwise make available on the Site (for example, comments, recipe variations, messages or other contributions).
Responsibility: You are solely responsible for User-Generated Content you submit and must ensure it does not violate any applicable law or third-party rights.
License to NomadMouse: By submitting User-Generated Content you grant NomadMouse a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable and transferable license to use, reproduce, modify, publish, translate, distribute, display, and otherwise exploit such content in any media or format now known or later developed. This license is required so NomadMouse can host, publish, archive, and share your contributions.
Moderation and removal: NomadMouse may, but is not obligated to, review, edit, remove, or refuse to post User-Generated Content for any reason, including content that is unlawful, abusive, infringing, defamatory, obscene, or otherwise objectionable.

7. Acceptable Use and Prohibited Conduct

You agree to use the Site only for lawful purposes and in compliance with these Terms. Prohibited activities include, but are not limited to:

Accessing the Site by automated means such as scraping, harvesting, data mining, robots, spiders, or other automated tools without our prior written permission.
Interfering with or disrupting the Site, servers, or networks (including denial-of-service attacks).
Attempting to gain unauthorized access to any portion of the Site, accounts, systems, or networks.
Copying, reproducing, distributing, or creating derivative works from Site content for commercial use without permission.
Uploading or posting content that infringes intellectual property or other rights of others or that is unlawful, fraudulent, defamatory, obscene, hateful, or pornographic.
Using the Site to send spam, phishing, malware, or otherwise malicious content.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section.

No warranty; “AS IS”: THE SITE, ITS CONTENT, SERVICES, AND ANY SOFTWARE PROVIDED ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. NOMADMOUSE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
No guarantee of accuracy or availability: We make reasonable efforts to present accurate information but do not guarantee the accuracy, completeness, or usefulness of any content. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
Third-party content: The Site may contain links to third-party sites. NomadMouse does not endorse and is not responsible for third-party content, products, or services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NOMADMOUSE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF NOMADMOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOMADMOUSE’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL BE LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID NOMADMOUSE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD 100), EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT LIMIT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS ON LIABILITY; IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless NomadMouse and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with (a) your breach of these Terms, (b) your User-Generated Content, or (c) your use of the Site in violation of applicable law or third-party rights.

11. Enforcement and Suspension

We reserve the right, without prior notice and in our sole discretion, to limit, suspend, or terminate your access to the Site (or any portion of it) and to delete, remove, or block any User-Generated Content that violates these Terms or is otherwise objectionable. We may also cooperate with law enforcement or government requests and disclose any information necessary to comply with legal processes.

12. Changes to the Site and These Terms

NomadMouse may modify, suspend, or discontinue any aspect of the Site at any time, including content, features, or hours of availability. We may update these Terms from time to time. When we do so we will update the “Last updated” date at the top of this page. Your continued use of the Site after the effective date of any revised Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Site.

13. International Users and Data Transfers

The Site is operated from the United States. If you access the Site from outside the United States, you consent to the transfer and processing of your information in the United States and other jurisdictions. For EU users, NomadMouse will take reasonable steps to comply with applicable data protection laws and provide required notices and rights as described in our Privacy Policy.

14. Links, Third-Party Sites, and Advertisements

The Site may contain links to third-party websites, services, or resources. These links are provided for your convenience only. NomadMouse is not responsible for the content, accuracy, policies, or practices of third parties and does not make any representations or warranties regarding them. Advertisements may appear on the Site; interactions with advertisers are at your own risk.

15. Termination

Either party may terminate access to the Site at any time for any reason. Sections that by their nature should survive termination (including Ownership, User-Generated Content license, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive termination.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect and the invalid provision will be replaced by a valid provision that most closely matches the intent of the original.

18. Entire Agreement

These Terms, together with any policies expressly referenced herein (including the Privacy Policy and Cookie Notice), constitute the entire agreement between you and NomadMouse relating to your use of the Site and supersede all prior or contemporaneous written or oral agreements concerning such subject matter.
